Terms of Service

1. Who we are
These terms govern the use of the platform by the restaurant that takes out a subscription (the
"Customer", "you"). By using the service, you accept them in full.
2. What RistoMaind does
RistoMaind is a dashboard which, depending on the plan, offers: booking management with automated
reminders, a website for the restaurant, a digital menu with QR code and table ordering, an AI assistant
that answers customers' questions about the menu, social content generation, review replies, cost analysis
and forecasts. The exact contents of each plan are those published at
ristomaind.com at the time of subscription.
Features not yet active. Some items in the plans are marked "coming soon": they are in
development and do not work yet. Subscribing to a plan that lists them does not guarantee an activation
date. Inactive features are also flagged as such inside the dashboard, and are not counted as available.
3. Free trial and plans
- The trial is free for 14 days and requires no credit card.
- You can cancel at any point within the 14 days at no charge.
- Plans and prices are those shown at ristomaind.com and
may be updated over time for new subscribers.
- Launch price locked in: anyone subscribing during the launch period keeps the agreed
price for at least 6 months, even if prices rise for new subscribers.
- Some plans carry a one-off setup fee, stated clearly before subscription.
4. Payments
- Payments are processed by Stripe. We never store your card details.
- The subscription renews automatically each month unless cancelled.
- You can cancel whenever you like, with no penalty and no lock-in. Cancellation takes
effect at the end of the period already paid for.
- If payment fails we may suspend access after reasonable notice.
Suspension is not deletion: your data stays where it is and becomes available again
as soon as payment resumes.
5. Your responsibilities
- Allergens. RistoMaind transcribes and organises the information you give it,
including by reading a photograph of your menu, but it does not independently verify the
accuracy of allergen data. Responsibility for giving your customers correct information
remains yours, under the law of the country you operate in — in the European Union, Regulation (EU)
1169/2011. Always check what you publish.
- Your customers' consent. You own the relationship with your venue's customers: before
switching on automated messaging you must have collected their consent.
- Do not use the service for unlawful purposes or to send unsolicited communications.
- Keep your dashboard credentials confidential.
- Data you upload must be yours or must be data you have the right to use.
6. AI-based features
Worth being clear about, since it is the heart of the product.
- AI-generated content can contain inaccuracies. Review it before publishing,
especially where allergens, prices and availability are concerned.
- Forecasts and advice — on footfall, costs, margins — are estimates based on the data you have
entered. They are not a guarantee of results nor professional advice, and their quality
depends on the quality and quantity of the data available.
- The assistant answers on the basis of what you have told it: menu, hours, house rules. It remains an
automated tool.
7. Ownership
- Content generated for your venue — posts, copy, images, the website, the menu — is
yours and you may use it freely.
- The RistoMaind name, the software and the platform remain the property of Salvatore Manzella.
- Images and text produced by third-party services are also subject to those providers' terms as
regards rights in AI-generated material.
8. Service availability
RistoMaind relies on third-party services — including Cloudflare, Google, Anthropic, OpenAI, Meta,
Stripe and Make.com — in order to function. We work to keep it running continuously, but we cannot
guarantee 100% availability and are not liable for interruptions caused by those providers when they lie
outside our reasonable control.
9. Limitation of liability
To the extent permitted by applicable law:
- The service is provided "as is" and we do not warrant that it will be free of errors or
interruptions.
- We are not liable for indirect damages, loss of profit or loss of custom arising from use or
non-use of the service, save in cases of wilful misconduct or gross negligence.
- Our total liability is limited to the amount you have paid for the service in the 12 months preceding
the event.
- Nothing here excludes liability that cannot be excluded by law.
10. Suspension and termination
We may suspend or terminate access, with reasonable notice except in serious or urgent cases, in the
event of a breach of these terms, unlawful use, prolonged non-payment, or conduct that harms the service or
other users.
You may end the relationship at any time by cancelling from the dashboard or writing to
info@nevermaindagency.com.
11. Personal data
Use of the service involves the processing of personal data, described in our
Privacy Policy. If you in turn process your own customers' data through
RistoMaind, a Data Processing Agreement compliant with Article 28 GDPR is available on
request.
12. Changes
We may update these terms. Where changes are substantial we will give you reasonable notice by email or
through the dashboard; continuing to use the service after that notice constitutes acceptance.
13. Governing law
These terms are governed by German law, Germany being the country in which the provider
of the service is established. Disputes fall under the jurisdiction of the courts of the provider's place
of establishment, without prejudice to any mandatory rules that apply.
